THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6314 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.11 under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.294 of 2012 on the file of the IV Metropolitan Magistrate, Bheemunipatnam.

Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 460, 471, 420 and 120-B r/w 34 IPC. It is stated that the petitioner and other accused created forged adangals relating to Sy.Nos.20/11 and 20/9 situated at Nerellavalasha village, Nidigattu Panchayat, Bheemili Mandal. and got registered the land in the said survey numbers in favour of A1 and A2. Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to interfere with the proceedings in the above C.C. At this stage, the learned Counsel for the petitioner submitted that NBWs were issued against the petitioner and the same may be recalled.

In view of the above submission, the petitioner is directed to surrender before the trial Court and move an application seeking to recall NBWs issued against him and on such application being filed, the trial Court is directed to recall NBWs issued against the petitioner and release him on condition of his executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum to the satisfaction of the trial Court. The petitioner is directed
