THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.24820 OF 2004 ORDER:

When the matter is taken up for hearing, it is noticed that the writ petition against respondent Nos.1 and 2 was dismissed for default, by order, dated 23.06.2011, and the petitioner has not taken any steps to ensure that the writ petition against respondent Nos.1 and 2 is restored. The petitioner filed the writ petition challenging the order, dated 02.09.2004, passed in I.A. No.52 of 2004 in W.C. No.38 of 2003 by respondent No.3 in favour of respondent Nos.1 and 2. In the absence of respondent Nos.1 and 2, the writ petition cannot be adjudicated on merits.

With the above observation, the present Writ Petition is dismissed. However, in the circumstances of the case, there shall be no order as to costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the present writ petition stand closed.
