JUSTICE ANIS CIVIL MISCELLANEOUS APPEAL NO.27 OF 2016 J U D G E M E N T (Per Hon'ble Sri Justice Sanjay Kumar) There was no representation for the appellant or its learned counsel when this matter was taken up for hearing on an interlocutory petition on 25.10.2016. Sri P.V.L.Bhanu Prakash, learned counsel on caveat for the 1st respondent, however informed this Court that the matter had been settled out of Court. The matter was accordingly directed to be posted for dismissal on 26.10.2016. Today, though the matter appears under the caption 'For Dismissal', there is no representation for the appellant or its learned counsel despite the matter being passed over. The appeal is accordingly dismissed for non-prosecution. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
