HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.19331 of 2019 ORDER:

This writ petition is filed seeking a Writ of Mandamus directing the respondents to promote the petitioner as MPDO/DIPO as per his seniority without reference to the charge memo dated 29.04.2017 issued by the 3rd respondent along with others in the existing vacancies in terms of G.O.Ms.No.257, dated 10.06.1999 with all consequential benefits by holding the action of respondents in not considering the petitioner's claim for promotion to the post of MPDO/DIPO on the sole ground that Departmental enquiry is pending vide Charge Memo dated 29.04.2017 and further considering the claims of others, as illegal, arbitrary, discriminatory and subversive of Articles 14 and 16 of the Constitution. When the matter is taken up for hearing, it is submitted by the learned counsel for the parties that this writ petition is covered to be disposed of in terms of the orders of this Court in W.P.No.2259 of 2019, dated 06.02.2019.

In view of the same, for the reasons recorded in the order dated 06.02.2019 in W.P.No.2259 of 2019, this writ petition is disposed of directing the respondents to consider the case of the petitioner for promotion to the post of MPDO/DIPO strictly in terms of G.O.Ms.No.257, dated 10.06.1999 and pass appropriate orders within a period of Six weeks from the date of receipt of a copy of this order. No order as to costs.
