THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.32462 of 2017 ORDER:

The present Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking the following relief: " .. declaring the action of the 2nd and 3rd respondents in not conducting enquiry and initiate disciplinary proceedings against the 5th respondent in doing clandestine business and irregular distribution of essential commodities to the card holders of F.P. Shop. No.18 of Rajavaram Village, Payakaraopeta Mandal, Visakhapatnam District, is illegal, arbitrary and in violation of the Provisions of A.P. Public Distribution System (Control) Order, 2008 and consequently direct the 2nd and 3rd respondents to conduct enquiry and take disciplinary action under the provisions of A.P. Public Distribution System (Control) Order, 2008 against the 5th respondent for in doing clandestine business and irregular distribution of essential commodities to the card holders for F.P. Shop. No.18 of Rajavaram Village, Payakaraopeta Mandal, Visakhapatnam District and pass such other order or orders as this Hon'ble Court deemed fit and proper in the circumstances of the case."

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. With their consent, the Writ Petition is disposed of at the stage of admission itself. Since this Court is not going into the merits of the case, there is no necessity to issue notice to R-5.

Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the authorities to consider the representation dated 11.07.2017, at the earliest.

In view of the same, the Writ Petition is disposed of directing the third respondent-The Revenue Divisional Officer to deal with the representation dated 11.07.2017, if permissible under law, and pass necessary orders thereon, in accordance with law, as early as possible, preferably within a period of six weeks from the date of receipt of a copy of this order.

Consequently, miscellaneous petitions pending in this petition, if any, shall stand closed.
