THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.21543 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of the second respondent in initiating the proceedings under Section 6A of the Essential Commodities Act for the commodities seized under the cover of panchanama dated 17.8.2015 as illegal and arbitrary.

2. Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies (A.P).

3. At the time of arguments, learned Government Pleader, on instructions, submitted that the proceedings under Section 6A of the E.C Act were initiated and the petitioner was directed to appear before the second respondent on 26.7.2016 at 4.00 PM.

4. Responding to the above submission, learned counsel for the petitioner submitted that the second respondent may be directed to dispose of the proceedings under Section 6A of E.C. Act as early as possible. The learned Government Pleader also consented for the same.

5. Having regard to the facts and circumstances of the case and also the submissions made by the learned counsel for both the parties, the second respondent is directed to dispose of the proceedings under Section 6A of E.C. Act initiated against the petitioner as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order. The second respondent is further directed not to sell the seized commodities till disposal of the proceedings under Section 6A of E.C. Act.

6. With the above direction, the writ petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
