HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.14771 of 2017 ORDER:
The petitioner was appointed as a regular Fair Price Shop Dealer in respect of Shop No.20 of Daivamdinne Village, Yemmiganur Mandal, Kurnool District, in the year 2008. While so, followed by a report received from the 4th respondent - Tahsildar, Yemmiganur Mandal, and the explanation dated 12.01.2017 offered by the petitioner, the 3rd respondent - Revenue Divisional Officer, Adoni, vide proceedings Rc.M.4196/2017, dated 25.03.2017, suspended the authorization of the petitioner's Fair Price Shop Dealership, pending enquiry. The 3rd respondent also issued a show cause notice of even date asking the petitioner to show cause as to why the authorization of his Fair Price Shop should not be cancelled.

According to the learned counsel for petitioner, the said impugned order dated 25.03.2017, in the facts and circumstances of the case, is unwarranted and highly arbitrary and illegal.

On the other hand, it is submitted by the learned Government Pleader for Civil Supplies that since variations pointed out are very high, indulgence of this Court is unwarranted and the petitioner is not entitled for any relief.

Having heard learned counsel for the respective parties, this Court is of the opinion that ends of justice would be served, if the petitioner is permitted to submit his explanation to the show cause notice dated 25.03.2017 within a period of one week from the date of receipt of a copy of this order. If any such explanation is received from the petitioner within the stipulated time, the same shall be considered and appropriate final orders be passed in accordance with law, after giving notice and opportunity of hearing to the petitioner, within a period of six weeks from the date of receipt of such explanation. If no final orders are passed within the stipulated time, the petitioner is entitled to lift the stocks seized by the respondents.

With the above direction, the writ petition is disposed of. As a sequel, Miscellaneous Petitions pending consideration, if any, in the Writ Petition shall stand closed. No order as to costs.
