THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY C.R.P.No.1296 of 2015
ORDER
This revision under Article 227 of the Constitution of India is filed challenging the docket order dated 29.12.2014 passed in O.S.No.159 of 2005 by the Principal Junior Civil Judge, Tirupathi. 2.
During pendency of this revision, the suit was dismissed on merits by judgment dated 16.10.2015.
3.
It is the contention of the counsel for petitioner that an appeal was preferred against the said dismissal in A.S.No.156 of 2016 pending on the file of III Additional District and Sessions Judge, Tirupathi. Therefore, he sought permission under Order 43 Rule 1(a) of C.P.C., to raise all the contentions before the appellate Court. 4.
Granting liberty as prayed for, the Civil Revision Petition is dismissed as infructuous. No order as to costs. Miscellaneous petitions, if any, pending in this revision shall stand dismissed. _______________________________ M. SATYANARAYANA MURTHY, J 6th March, 2018 sj
