THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19333 of 2019 O R D E R :

This writ petition is filed challenging the action of the respondent No.3 in threatening to dispossess the petitioners from their lawful possession in respect of the land in Sy.No.26/A, admeasuring Ac.2.01 guntas, situated at Mandalapalli Village, Dammapeta Mandal, Bhadradri Kothagudem District, at the behest of 4th respondent, without there being any order either to interfere or dispossess the petitioners from the above said land.

Heard learned counsel for the petitioners and learned counsel for the 4th respondent.

Admittedly, injunction was granted in favour of 4th respondent in IA.No.281/2014 in OS.No.385/2014 and the same was confirmed by this Court vide order dt.02.09.2016 in CRP.No.2123 of 2016. Pursuant to the same, the 4th respondent filed application for grant of police aid and when the said application was dismissed by the Court below, 4th respondent filed CRP.No.190 of 2017 and this Court granted interim direction in the said CRP vide order dt.16.04.2019 in IA.No.1 of 2017 in CRP.No.190/2017.

Though the aforesaid facts are not in dispute, learned counsel for the petitioners submits that still the suit is pending.

Learned Assistant Government Pleader for Home produced written instructions stating that on the complaint of the 4th respondent Crime No.126 of 2019 is registered against petitioners on 20.08.2019. It is to be seen that when injunction order as well as police protection order is in favour of 4th respondent, the petitioners cannot contend otherwise. In view of the same, I do not see any reason to entertain this writ petition.

Accordingly, the writ petition is dismissed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
