This writ petition is filed challenging the order of the 2nd respondent vide proceedings No.HN/A2/Arms/6695/2018-19, dt.0608-2019. Learned Counsel for the petitioner submits that the request of the petitioner for renewal of his Arms Licence beyond 31.12.2018 was rejected and his Arms Licence was cancelled only on the ground that the petitioner does not have any threat perception and that the said ground does not come within the parameters of Sections 13 and 14 of the Arms Act.
Heard learned Government Pleader for Home who submits that when petitioner does not have threat perception, question of granting Arms Licence does not arise.
This Court had an occasion to deal with the similar issue and allowed WP.No.8711 of 2019, wherein also the application of the petitioner therein for Arms Licence was rejected on the same ground of lack of threat perception. In view of the same, and for the reasons alike this writ petition is allowed and the impugned proceedings dated 06.08.2019 issued by the 2nd respondent are set aside. Further the competent authority is directed to reconsider the request of the petitioner for renewal of his arms licence. No order as to costs.
Accordingly, the Writ Petition is also allowed. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
