THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.21173 of 2014 ORDER:

Heard learned counsel for the petitioners as well as learned Government Pleader appearing for the respondents 1 to 3. 2.

The prayer sought in the writ petition is as under:- "....to issue an appropriate writ order or direction more particularly one in the nature of Writ of Mandamus under Article 226 of Constitution of India declaring the action of respondents in registering the Crime No.417 of 2014 by the 3rd respondent showing the petitioners' tractors and trailers as accused is arbitrary, illegal and unknown to law and against the provisions of Criminal Procedure Code and consequently direct the respondents 1 to 3 not to arrest the petitioners without following due course of law and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned counsel for the petitioners informs the Court that the matter has become infructuous, since the trial in the subject crime was already concluded, whereby the accused were acquitted. 4.

In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. No order as to costs.
