THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19351 of 2019 O R D E R :

This writ petition is filed challenging the action of the 3rd respondent in calling the petitioners to the III town Police Station, Karimnagar, colluding with unofficial respondents and consequently direct the 3rd respondent not to interfere with the peaceful possession and enjoyment of the petitioners.

Learned Assistant Government Pleader for Home produced written instructions dt.04.09.2019, submitted by the Asst.SubInspector of Police, Karimnagar III town Police Station, Karimnagar District.

To the extent of their relevance to the present writ petition, the said instructions read as under.

"It is submitted that the petitioners gave a complaint to the Commissioner of Police, Karimnagar on 16.08.2019, stating that Jinka Anjaiah and others illegally and forcibly ploughing their land in Sy.No.94 to an extent of Ac.2.32 guntas situated at Kisannagar locality of Karimnagar revenue village. It is submitted that the same was forwarded to the Inspector of Police, Karimnagar III Town for causing enquiry, wherein the Inspector of Police caused enquiry and it was disclosed that no such incident took place as stated by the petitioners and the matter is purely civil in nature. As such advised the petitioners to approach the Hon'ble Civil Court for remedy. It is submitted that the allegations made by the petitioner that the 3rd respondent is calling them to police station is false and

denied herewith as the 3rd respondent never called the petitioners to police station at any point of time. It is submitted that except causing enquiry on the complaint given by the petitioners to the Commissioner of Police, the respondent No.3 never interfered into the civil disputes of the petitioner."

Learned Counsel for the petitioners states that the order dt.01.08.2019 passed by the Revenue Divisional Officer, Karimnagar, in the appeal No.D/5919/2018, under Section 5(5) of the Rights in Land and Pattadar Pass Books Act, 1971, was also in favour of petitioners.

In view of the same, recording the written instructions submitted by the learned Assistant Government Pleader, the Writ Petition is disposed of directing the respondent police not to interfere with the life and liberty of petitioners and also not to interfere with the civil disputes pending between the petitioners and unofficial respondents, except in accordance with law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
