THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.835 of 2016 ORDER:

This Criminal Petition is filed by the petitioners- accused Nos.2 & 4 under Section 438 Cr.P.C. seeking to grant anticipatory bail to them in Crime No.338 of 2015 on the file of Jangaon Police Station, Jangaon Warangal District, registered for the offence punishable under Sections 290, 323 IPC and Section 3(1)(x) of the SCs & STs (POA) Act.

Heard and perused the material available on record. It is alleged that the de facto complainant took the land from one Maddula Malla Reddy on lease and he is cultivating it. On 19.12.2015, while he was cultivating the land, one Maddula Thirumal Reddy, the petitioners and one Thirumala came to the land and abused the de facto complainant in the name of his caste.

Considering the facts and circumstances of the case and the nature of the offence, this Court is inclined to pass the following order: The petitioners-accused Nos.2 & 4 are directed to surrender before the Court concerned and file an application for regular bail. On such application being filed, the Court concerned shall consider the same on the same day in accordance with law.
