THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5536 of 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioner/accused, seeking to grant anticipatory bail in Cr.No.161 of 2019 on the file of Chengomul Police Station, Vikarabad District, registered for the offence under Section 307 IPC.

Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor representing the 1st respondent-State and perused the record.

It is alleged in the complaint that on 23.08.2019 at 1100 hours, due to petty quarrel with regard to drainage water, the petitioner/accused attempted to kill the de-facto complainant with a spade resulting cut injury on his right eyebrow. 4.

Learned counsel for the petitioner/accused submits that the allegations made against the petitioner are absolutely false and concocted and a false case has been foisted against him as a counter case as the mother of petitioner, who is victim in the hands of the de-facto complainant, lodged a case against him for breaking the cameras etc. He further submits that the allegations made in the complaint do not attract the offence under Section 307 IPC and that due to political rivalry and without application of mind, the police registered the aforesaid crime. He further submits

that the petitioner is a permanent resident of locality and he is ready to furnish the sureties to the satisfaction of the Court. 5.

Having regard to the facts and circumstances of the case and the involvement of the petitioner in the crime by using weapon, I am not inclined to grant anticipatory bail to him and his prayer for anticipatory bail is refused. However, if the petitioner/accused surrenders before the trial Court within 15 days from today and moves an application for bail, the trial Court may consider the same in accordance with law.

Accordingly, the Criminal Petition is dismissed. 7.

Miscellaneous applications, if any pending in this criminal petition, shall stand dismissed.
