THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15666 of 2003 ORDER:

This writ petition is filed seeking the following relief: " .. to issue an Order, Direction or a writ one in the nature 'MANDAMUS' declaring (i) the action of the respondents in denying the payment of 50% more compensation on par with the 2nd batch of employees who retied under Circular No.81/ 2001, dt.05.12.2001 as illegal, arbitrary, discriminatory and violative of Art.14 of the Constitution of India (II) Clause 4, 3 of Circular No.81/ 2001, dated 05.12.2001 is also applicable to the petitioners who retired under Circular No.71/ 2000, dated 04.12.2000 and circular No.80/ 2000, dated 26.12.2000, as the wage revision due as on 01.01.1997 has not been effected by the respondents, the petitioners are legally entitled for payment 50% more compensation on par with the 2nd batch of employees who retired under Circular No.81/ 2001, dated 05.12.

2001 and consequently direct the respondents to pay the petitioners 50% more compensation on par with the 2nd batch of employees who retired under Circular No.81/ 2001 dated 05.12.2001 forthwith and pass such other relief or reliefs as this Honourable Court may deems fit just and necessary in the circumstances of this case."

When the matter is taken up for hearing, learned counsel appearing for the petitioners submitted that in the light of the decision rendered in the case of Vice Chairman and Managing Director, APSIDC Limited v. R.Vara Prasad 1, the writ petition is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. No order as to costs.
