THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL MISCELLANEOUS APPEAL No.4610 of 2003 JUDGMENT:
None appears for the appellant.
The present appeal is filed against the award in O.P.No.419 of 1998, dated 26.08.2003, passed by the Motor Accidents Claims Tribunal, Anantapur. The appellant is the claimant. He filed the claim petition claiming compensation of Rs.1,00,000/- for the injuries sustained by him in a motor accident that occurred on 15.05.1997. The Tribunal dismissed the petition on the ground that there was ambiguity with
regard to the date of accident. The Tribunal came to that conclusion on the basis of the evidence adduced before it.
However, in the present appeal, the appeal was dismissed for default as against the first respondent, who is the owner of the jeep, by order dated 29.04.2014. In the absence of the owner of the vehicle, the present appeal cannot be maintained against the Insurance Company alone.
In the circumstances, the appeal is dismissed.
The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
