ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.4 in Crime No.312 of 2026 before the Keesara Police Station,

Malkajgiri District, registered for the offence punishable under Sections 310(2) of BNS.

The brief facts of the case are that on 06.04.2026, the de facto complainant was allegedly induced by an unknown person travelling in a car to accompany him on the pretext of showing the route to Rampally Village. Thereafter, near Ghatkesar, four more persons allegedly joined the car and took the complainant to Bacharam Village through the ORR service road. It is alleged that the accused forcibly removed the complainant from the vehicle, snatched his gold chain weighing about 16 grams, tore his T-shirt and fled from the spot. Based on the complaint, a Zero FIR was registered and subsequently transferred, resulting in registration of Crime No.312 of 2026 for the offence punishable under Section 310(2) of the BNS. The petitioner was arrested and remanded to judicial custody.

Heard Sri Veera Babu Gandu, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the case without any proper investigation and that the petitioner has been made an accused merely because of his alleged involvement in previous cases and that there is no credible material connecting him with the present offence. He further submits that the investigation is substantially completed, statements of witnesses have already been recorded and nothing remains except filing of the charge sheet. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition.

Learned Additional Public Prosecutor opposed the bail application contending that the petitioner is involved in a serious offence relating to robbery/snatching of a gold chain from the de facto complainant and that the investigation has revealed the involvement of the petitioner along with the other accused in the commission of the offence and that sufficient material has been collected against him. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 11.04.2026. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 12 witnesses have been examined.

Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the III Additional Judicial Magistrate of First Class, Medchal-Malkajgiri District at Kushaiguda.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet

whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
