THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.5363 of 2018 ORDER:

This petition is filed under Section 482 Cr.P.C. challenging the orders dated 20.04.2018 in Crl.M.P.No.1953 of 2018 in C.C.No.142 of 2017 on the file of the Court of IV Additional Junior Civil Judge, Guntur. 2.

At the time of hearing, learned counsel for the petitioner Sri D.Bhaskar Reddy, seeks permission of this court to permit the petitioner to withdraw the Criminal Petition with a liberty to appear before the trial Court and file a petition under Section 70(2) Cr.P.C. He further submitted that the trial Court may be directed to dispose of the petition if any filed by the petitioner under Section 70(2) Cr.P.C. on the same day. Permission as sought for is granted.

Accordingly, this Criminal Petition is dismissed as withdrawn. The petitioner is permitted to appear personally before the trial Court and file a petition under Section 70(2) Cr.P.C. The trial Court is hereby directed to dispose of the petition filed by the petitioner on the same day, in accordance with law. As a sequel, the miscellaneous petitions, pending if any, shall stand closed.
