THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.3616 OF 2013 ORDER:
This criminal petition is filed under Section 482 of Cr.P.C to quash the proceedings in Crime No.11 of 2013 pending on the file of Kanekal Police Station, Ananthapur District, for the offence punishable under Section 324 r/w 34 IPC.
Though, notice before admission was ordered on 26.04.2013, still notice was not yet served.
Learned Public Prosecutor for the State of Andhra Pradesh submitted that the entire investigation was completed and charge sheet was filed on 27.04.2013 and registered as C.C.No.59 of 2013 on the file of Judicial First Class Magistrate, Raidurg. It is evident that this petition was filed on 15.04.2013. But, this Court did not grant any stay. Therefore, the investigating agency completed the investigation and filed charge sheet. When once the investigation is completed and charge sheet is filed and registered as calendar case, the question of quashing the proceedings in crime does not arise. Therefore, the criminal petition is dismissed as infructuous. However, the petitioners are at liberty to challenge the proceedings in calendar case, if advised. With the above observation, the criminal petition is dismissed as infructuous.
