HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.35933 OF 2016 ORDER:

This writ petition under Article 226 of the Constitution of India is preferred by the petitioner seeking to declare the inaction of the 2nd respondent in passing orders in the appeal filed by him on 29.08.2016, as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Asst. Government Pleader for Revenue (AP). With their consent, the Writ Petition is disposed of at the stage of admission itself. A perusal of the material on record would show that earlier the petitioner approached this Court by way of filing W.P.No.12854 of 2016, which was disposed of by this Court vide order dated 19.04.2016 observing as follows:

" .... this Writ Petition is disposed of directing the petitioner to file an application in Form 6A as prescribed under the Act before the 3rd respondent therein; and if such an application is filed by the petitioner, the 3rd respondent shall consider the same and pass orders thereon within a period of six (06) weeks from the date of receipt of said application and communicate his decision thereon to the petitioner. There shall be no order as to costs."

Pursuant thereto, the petitioner is alleged to have made an application through Mee-Seva on 26.05.2016. It is stated that till date no orders came to be passed on the said application. Petitioner is also alleged to have preferred an appeal questioning the inaction of the part of the Tahasildar. But, however, learned

counsel for the petitioner would submit that Tahasildar may be directed to pass appropriate orders on the application made by the petitioner in form 6A seeking mutation of his name in pattadar passbook at the earliest.

Learned AGP would submit that if the application of the petitioner is still pending consideration, the Tahasildar may be directed to dispose of the same in accordance with law. Having regard to the rival submissions made, the Writ Petition is disposed of directing the 4th respondent-Tahasildar to dispose of the application made by the petitioner on 26.05.2016 in Form 6A pursuant to the order of this Court in W.P.No.12854 of 2016 dated 19.04.2016 after hearing the petitioner and the aggrieved persons, if any, in accordance with law as early as possible preferably within a period of six weeks from the date of receipt of a copy of this order.
