HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.11263 of 2015 ORDER:
Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Andhra Pradesh.
2. This writ petition is filed seeking writ of Mandamus declaring the action of the 4th respondent in passing orders dated 18.03.2015 by suspending authorization of F.P. shop No.7 of Marthadu Village,Garladinne Mandal, Anantapur District, as illegal and arbitrary.
3. The Fair Price shop of the petitioner was inspected by the authorities and certain variations have been noticed in the stock, apart from some other irregularities. Basing on the said irregularities, charges have been framed against the petitioner. By order dated 18.03.2015, the 4th respondent-Revenue Divisional Officer, Ananthapur, suspended the authorisation of the petitioner.
4. Having regard to the charges levelled against the petitioner, this Court is not inclined to go into merits of the suspension of the authorisation and a detailed enquiry has to be conducted against the petitioner. Therefore, the 4th respondentRevenue Divisional Officer, Anantapur, is directed to conduct enquiry against the petitioner and pass final orders within a period of eight (8) weeks from the date of receipt of a copy of this order.
