THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.27423 of 2007 ORDER:

This writ petition is filed for the following relief: "to issue Writ order or Direction more particularly one in the nature of writ of Mandamus, declaring the 2nd respondent's Proceeding No.003/RCS/2003-3, dated 29.7.2003, the subsequent order of the 3rd Respondent Government in G.O.Ms.No.29, Animal Husbandry Dairy Development and Fisheries (Dairy-II) Department, dated 19.4.2006 and the Consequential Deed of Compromise dated 11.9.2006 entered into between the 5th and 6th Respondents and the subsequent letter of the 3rd respondent Government in Lr.No. 2637/DY. II(2)/2005 dated 15.12.2007 as illegal, unlawful, contrary to the letter and spirit of the provisions of the Cooperative Societies Act and Violative of Articles 19(1) (g) and 21 of the Constitution of India and set a side the same." On the last occasion, learned counsel for the petitioner sought time for getting instructions from his client in the matter. Today, when the matter is taken up, learned counsel for the petitioner submits that in spite of his best efforts, he could not get instructions from his client.

Learned counsel Pleader for Cooperation and learned Standing Counsel for respondent No.4-A.P.Dairy Development Corporation Federation Limited, by placing on record a note prepared by respondent No.4, submit that pursuant to the orders in G.O.Ms.No.29, dated 19.04.2006, necessary steps were taken and as on date, Balaji Dairy has been taken over by the National

Dairy Development Board and that pursuant to the Scheme formulated, amounts were also settled to the respective parties. Recording the above said submission, leaving it open to the petitioner to seek revival of the matter as and when necessary, the writ petition is closed as infructuous.

Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
