HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1898 OF 2017 ORDER:

This writ petition is filed for a writ of certiorari calling for records relating to eviction proceedings issued by the 2nd respondent in contrary to the provisions of Section 4(1) (b) of the A.P.Land Assigned Lands (Prohibition of Transfers) Act, 1977, in respect of the land in R.S.No.348/4,5,6,7 of Pendurru Village Bantumilli Mandal, Krishan District, as illegal and arbitrary. Heard.

Admittedly, an appeal lies against the impugned order and the same is not disputed by the learned counsel for the petitioner. In view of the same, I am not inclined to entertain the writ petition. Accordingly, the writ petition is dismissed granting liberty to the petitioner to avail alternative remedy available under law. However, there shall be stay of impugned proceedings for a period of three (03) weeks from today. There shall be no order as to costs.
