HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN Civil Revision Petition No.2828 of 2016 ORDER:
Aggrieved by the dismissal of an application filed by the petitioners herein-defendants 2 and 3 in the suit, seeking to mark an agreement of sale dated 03-01-1999 as an exhibit, by the order dated 30-03-2016 in I.A.No.923 of 2015 in O.S.No.79 of 2002 passed by the XIII Additional District Judge, Vijayawada, the defendants 2 and 3 have come up with the above revision petition. Heard Sri G. Jayendra Balaji, learned counsel for the petitioners.
On a previous occasion, the very same agreement of sale was sent to the Revenue Department for collection of proper stamp duty. Without completing the formalities, the document again came back to Court. The previous order sending the document for collection of appropriate stamp duty has already attained finality in C.R.P.No.5603 of 2012.
Therefore, a second application is not maintainable. Hence, the Civil Revision Petition is dismissed. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. ________________________ V. RAMASUBRAMANIAN, J Date: 24-06-2016 Ksn
