THE HON'BLE SRI JUSTICE A.VENKATESHWARA REDDY CIVIL MISCELLANEOUS APPEAL NO.855 OF 2019 JUDGMENT:

It is submitted by the learned counsel Sri. Syed Razzaq Ahmed that he has given no objection long back and the same is also recorded in the court proceedings. Verified that on 18.01.2022 such representation was made and the notice to the appellant was sent. It was returned with the endorsement left the country and the door locked. Be it stated that, in such circumstances no further steps are required to draw the attention of the appellants.

2. However, learned counsel Sri. Kotha Jagan Mohan Reddy would submit that pursuant to the orders in OA.7 of 2015 Sri. Kovela Ranganayaka Swamy Temple has already taken possession of the property on 12.09.2020. In such circumstances, as the appellant remained absent and the notice sent from this court subsequent to 18.01.2022 returned as indicated above. I am inclined to accept the submission made by the learned counsel as to delivery of possession.

3. Therefore, while recording the submissions made by Sri. Jagan Mohan Reddy, the Civil Miscellaneous Appeal is disposed of.

4. In the circumstances of the case, there shall be no order as to the costs.

5. Miscellaneous applications, if any pending, shall stands closed.
