HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 6204 of 2012 Order:

This Writ Petition was filed challenging the action of the respondents in not releasing the retention amount against the bank guarantee, based on a memo, dated 23.12.2008, which is subsequent to the date of agreement.

2. This Court, by an order dated 07.03.2012, directed the respondents to release the retention amount against the bank guarantee as well as in future bills pertaining to the agreement dated 25.02.2005.

3. When the matter is taken up for hearing, learned counsel for the petitioner submits that pursuant to the said interim direction, the retention amount was released against the submission of bank guarantee and, in view of that, nothing survives for consideration in the present Writ Petition.

4. Recording the said submission, the Writ Petition is closed. There shall be no order as to costs.

5. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
