Heard learned counsel appearing for the petitioner and learned Standing Counsel appearing for respondents 1 and 2.

This writ petition is filed seeking to declare the action of the respondents in granting full time permission of whole one year to the 1st petitioner as arbitrary and illegal.

Petitioners 1 and 2 are President and General Secretary of Telangana State Power Employees Union. The 1st respondent-Corporation has been following the procedure by granting full time permission to the President and the Secretary for six months each, so as to enable the office bearers of major trade unions to devote their full time to the trade union activities for industrial harmony and peace. After formation of TS Genco, the petitioners submitted a representation dated 24.12.2014 to the respondents to accord full time permission to the President and General Secretary of the Union for six months each i.e., from 1.1.2015 to 30.06.2015 to

the 1st petitioner and from 1.7.2015 to 31.12.2015 to the 2nd respondent. But the 2nd respondent vide Memo dated 6.2.2015 granted full time permission to the 1st petitioner only from 1.1.2015 to 31.12.2015.

Hence the petitioners made representation dated 9.4.2015 and another representation dated 5.2.2015 to the respondents. But, so far no orders have been passed thereon by the respondents.

Learned counsel appearing for the petitioners submits that when the existing procedure is to grant full time permission to the President and General Secretary, there is no justification on the part of the respondents to grant full time permission of whole one year to the 1st petitioner.

Considering the facts and circumstances of the case, the Writ Petition is disposed of directing the respondents to consider the representation made by the petitioners on 5.2.2015 whereunder they sought to grant full time permission from 1.1.2015 to 30.06.2015 to the 1st petitioner and from 1.7.2015 to 31.12.2015 to the 2nd petitioner i.e., six months each, according to rules. No costs.

As a sequel, Miscellaneous Applications, if any, shall stand closed.
