This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.708 of 2026 of Chaitanyapuri Police Station, Malkajgiri. The offences alleged against the petitioner is under Section 69 of the BNS.

The case of the prosecution is that the de-facto complainant became acquainted with accused No.1 in May
2023, and he allegedly developed a relationship with her on the promise of marriage despite being aware of her previous marriage and divorce. It is alleged that, on the strength of such promise, accused No.1 had physical relations with the complainant on several occasions between 31.05.2024 and 09.04.2026, but subsequently refused to marry her. It is further alleged that accused No.1 borrowed an amount of about Rs.1,50,000/- from the complainant during the course of their relationship. Based on the said complaint, the police registered a case for the aforesaid offence.

Heard Ms.Sahthi Sri Kavya, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondentState. 4.
The contention of the petitioner is that he is innocent and has been falsely implicated in the present case. It is contended that the petitioner and the de-facto complainant were acquainted with each other and maintained a consensual relationship for a considerable period and the allegations of physical intimacy on the promise of marriage are disputed by the petitioner. It is further submitted that the de-facto complainant has suppressed the fact that she was
already married and had not obtained a decree of divorce at the time she entered into a relationship with the petitioner. It is further submitted that petitioner has no criminal antecedents and is ready to cooperate with the investigation and hence, she prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition. 5.
On the other hand, the learned Additional Public Prosecutor opposed the bail application, contending that the offence alleged against the petitioner is serious in nature and by making a false promise of marriage, induced the de-facto complainant to enter into a physical relationship with her and thereafter refused to marry her and therefore, he is not entitled to the grant of anticipatory bail. Therefore, he prayed the Court to dismiss the Criminal Petition.

Considering the submissions made by both sides and the material available on record, it is noted that the de-facto complainant was a married women at the date of allegations and also the petitioner has specifically contended that the defacto complainant suppressed the fact that she was already married and had not obtained a decree of divorce when she entered into a relationship with him. Further, the investigation can be proceeded with while safeguarding the
liberty of the petitioner. Having regard to the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, Chaitanyapuri Police Station, Medchal Malkajgiri, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of 8 weeks or
till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
