Heard learned Counsel for the petitioner and the learned Government Pleader for Prohibition and Excise for respondents. Admittedly, confiscation proceedings are pending consideration before the Deputy Commissioner, Prohibition & Excise, Nirmal Division, Nirmal District-second respondent herein. Therefore, it is open for the petitioner herein to move an appropriate application before the second respondent and, If any such application is filed for release of the stock, the same be considered and appropriate orders be passed, strictly in accordance with law.

Accordingly, the Writ Petition is closed. There shall be no as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
