HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.10533 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Andhra Pradesh.

This writ petition is filed seeking writ of Mandamus declaring the inaction of the 3rd respondent-Revenue Divisional Officer in suspending his authorisation as fair price shop dealer of the fair price shop No.16 of Jaladi Village, Edlapadu Mandal, Guntur District, by proceedings dated 20.03.2015, as illegal and arbitrary and for a consequential direction to the respondents to allow the petitioner to continue as fair price shop dealer.

3. The fair price shop of the petitioner was inspected and certain irregularities in the stock have been noticed by the authorities. This apart the impugned order shows that some other irregularities have been found. Learned counsel appearing for the petitioner would submit that the variations pointed out at the time of inspection are very minor and within the permissible limits and the Revenue Divisional Officer ought not to have suspended the authorisation of the petitioner. As can be seen from the order passed by the 3rd respondent-Revenue Divisional Officer, variations in the stock pointed out during the course of inspection are not minor and they are beyond permissible limits. This Court is therefore not inclined to examine the merits of the suspension order.

4. Having regard to the charges mentioned in the impugned order, this Court is of the view that a detailed enquiry needs to be conducted into the allegations levelled against the petitioner.

Consequently, the Revenue Divisional Officer-3rd respondent is directed to conduct enquiry against the petitioner and pass final orders within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed.

No order as to costs.
