HON'BLE SRI JUSTICE C. PRAVEEN KUMAR Criminal Petition No.632 of 2015 ORDER:

The petitioners, who are accused Nos.1 and 2, filed the present application under Section 438 Cr.P.C. seeking release in the event of their arrest in connection with Crime No.237 of 2014 of Giddalur Police Station, Prakasham District, registered for the offences punishable under Sections 384 and 365 read with 34 IPC and Section 27 of the Arms Act. Though the present application is filed seeking anticipatory bail, but the learned counsel for the petitioners seeks a direction to the concerned Court to deal with the bail application filed by the petitioners in the event of their surrender on the same day.

Having regard to the circumstances stated in the petition and also taking into consideration the nature of transaction involved, the petitioners if so advised shall surrender before the Court concerned and move an application for bail before an appropriate Court after giving prior notice to the public Prosecutor, in which event the same shall be dealt with in accordance with law either on the same day or atleast by next day.
