THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 5132 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/A6 to A8 seeking bail in the event of their arrest in connection with Crime No.44/2022 on the file of Talamadugu Police Station, Adilabad District, registered for the offences punishable under Sections 306 read with 511, 447, 506 read with 34 of Indian Penal Code.

The case of the prosecution is that on 05.06.2022 some named persons who are A1 to A5 entered into the fields of the defacto complaint along with twenty other male and female persons who were armed with axes and attacked. However, due to the threat of the said attack the husband of the defacto complainant consumed poison. However, he survived.

Since the names of all these petitioners are not mentioned in the complaint, these petitioners can be granted the relief of anticipatory bail on the following conditions.

1) The petitioners/ A6 to A8 are directed to surrender before the Station House Officer, Talamadugu Police Station,

Adilabad District, within a period of 10 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners/ A6 to A8 on bail, on their executing personal bonds for a sum of Rs.20,000/- (Rupees twenty thousand only) each with two sureties in a like sum each to his satisfaction.

2) On such release, the petitioners/ A6 to A8 shall appear before the said Station House Officer on every Monday between 10.00 a.m to 5.00 p.m. for a period of two months for the purpose of investigation.

3) The petitioners/ A6 to A8 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the criminal petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
