HON'BLE SRI JUSTICE SURESH KUMAR KAIT Criminal Petition No.15381 of 2016 ORDER:

This Criminal Petition is filed under Section 438 Cr.P.C. seeking to grant anticipatory bail to the petitioner - accused No.2 in connection with Crime No.24 of 2016 of Pellakur Police Station, SPSR Nellore District, registered for the offences punishable under Sections 420, 417, 464, 468, 465 and 471 I.P.C.

The learned Additional Public Prosecutor appearing on behalf of the State has informed this Court that the petitioner has filed another bail application vide Crl.P.No.11574 of 2016 and the same was dismissed on 22-08-2016 by this Court and thereafter there is no change of circumstances, hence, the present application is not maintainable. Keeping in view the fact that this Court has already dismissed the bail application of the petitioner vide order, dated 22-08-2016 and thereafter there is no change of circumstances in the present case, I am not inclined to allow the present petition.

Accordingly, the Criminal Petition is hereby dismissed. As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
