THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.8501 OF 2015 ORDER: (per the Hon'ble Sri Justice Sanjay Kumar) The petitioner is aggrieved by the inaction on the part of the Kurnool Municipal

Corporation in disposing of the complaint dated 3.3.2015 filed in the context of the property tax demand notice dated 1.3.2015. Her grievance was that the property tax was enhanced from Rs.1,373/- to Rs.11,117/- at one go. Sri S.D. Goud, learned Standing Counsel for the Kurnool Municipal Corporation, states on instructions that no orders have been passed upon the complaint filed by the petitioner.

In that view of the matter, we dispose of the writ petition directing the Commissioner, Kurnool Municipal Corporation, Kurnool, to afford a personal hearing to the petitioner after giving due notice and thereupon pass a reasoned order on the complaint petition dt.3.3.2015. This exercise shall be completed within a period of three weeks from the date of receipt of a copy of this order. In the event the petitioner does not respond to the notice issued by the Corporation, our order shall stand recalled and the Corporation would be at liberty to proceed in accordance with law. Pending the exercise by the Corporation, the petitioner shall pay the admitted dues of property tax without prejudice to the rights and contentions of the parties. The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
