THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.5195 of 2005 ORDER:
This writ petition is filed under Article 226 of the Constitution of India to issue a writ of mandamus, setting aside the impugned Proceedings Rc.No.5748/B3/2004, dated 22.1.2005 issued by the second respondent rejecting the claim of the petitioner for promotion to the post of B.Ed Asst., (Social Studies) as illegal, arbitrary, vindictive, apart from violation of Articles 14 and 21 of the Constitution of India and consequently direct the respondents to promote the petitioner as B.Ed Asst., (Social Studies).
2. The learned counsel for the petitioner seeks permission of this court to permit the petitioner to withdraw the writ petition with liberty to avail all the remedies available to him under law including making of representation to the concerned authority to consider his case for promotion in future vacancies if he is otherwise qualified. Permission is granted.
3. Accordingly, the writ petition is dismissed as withdrawn granting liberty as prayed for. Miscellaneous petitions if any pending in this writ petition shall stand closed.
