THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 19374 of 2019 O R D E R :

This writ petition is filed for the following relief; "...to issue an appropriate writ, order or direction more especially one in the nature of Writ of Mandamus to declare the action of the respondents in installing of sign boards in the petitioners land admeasuring Ac.17.30 guntas in Survey Nos.41, 174, 177, 178, 179, 180/1, 181, 182 and 211, situated at Toli Chowki, Shaikpet Village and Mandal, Hyderabad district, stating that it is under attachment by the CCS police in pursuant to G.O.Rt.No.649, Home (Passports) Department, dated 27.06.2019, issued by the first respondent pertaining to Item Nos.4 to 14 and 16 of Annexure-I and Item Nos.1 and 2 of Annexure-II is bad, illegal, malafide one and without any authority pending objection petition and confirmation G.O. by the Hon'ble Metropolitan Sessions Judge, consequently to remove the said sign boards."

Learned Counsel for the petitioners submits that even before the order of attachment vide G.O.Rt.No.649, dt.27.06.2019, is made absolute by the adjudicating authority, the respondents have put up sign boards on the land belonging to the petitioners which was given possession to the petitioners by the Court Bailiff. Learned Government Pleader for Home submits that in order to caution and protect the prospective purchasers, if any, and also to avoid the multiplicity of proceedings in case of purchase by any third

parties, notice board is erected in the subject land. He further submits that in the said sign board the words "trespassers will be prosecuted" were deleted.

In this case it is to be seen that when the respondent authorities are trying to attach the properties of the petitioner by virtue of the aforesaid G.O.Rt.No.649, dt.27.06.2019, the petitioner filed WP.No.15019 of 2019 and the same was disposed of by this Court directing the petitioners to approach the adjudicating authority by filing their objections in support of their claim. In view of the above facts and circumstances, I do not see any reason to entertain the present writ petition.

Accordingly, the writ petition is dismissed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
