THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 5131 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/A1 to A4 seeking bail in the event of their arrest in connection with Crime No.362 of 2022 on the file of Patancheru Police Station, Sangareddy District, registered for the offences punishable under Sections 406, 420 of Indian Penal Code, Section 4(1) read with 76 of the Telangana State Chit Fund Act, 1982 and Section 3 read with Section 4 of the Prize Chits & Money Circulation Schemes (Banning) Act, 1978. 2.

The case of the prosecution is that a complaint was filed on 04.06.2022 alleging that 1st and 2nd petitioners were husband and wife who were in fact running chit fund business and accordingly several amounts were taken from nearly 150 persons. Thereafter, a meeting was convened and finally it was agreed that they would return the amounts. However, the petitioners are now absconding without paying the outstanding amounts.

In the said circumstances, this Court is not inclined to grant the relief of anticipatory bail to petitioners 1 & 2. 4.

In the entire complaint, there is no mention of petitioners 3 and 4 involvement, who are the daughter and son of petitioners 1 & 2.

For the said reason, the petitioners 3 and 4 can be granted the relief of anticipatory bail on the following conditions.

1) The petitioners 3 & 4/A3 & A4 are directed to surrender before the Station House Officer, Patancheru Police Station, Sangareddy District, within a period of 10 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners 3 & 4/ A3 & A4 on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties in a like sum each to his satisfaction.

2) On such release, the petitioners 3 & 4/A3 & A4 shall appear before the said Station House Officer as and when required for the purpose of investigation.

3) The petitioners 3 & 4/A3 & A4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall cooperate with the Investigating Officer in investigating the case. 6.

Accordingly, the Criminal Petition is dismissed against petitioners 1 and 2 and allowed against petitioners 3 & 4.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
