THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR W.P. NO. 28402 of 2015 ORDER:

Heard both sides.

The petitioner intends to register a development agreement-cum-power of attorney presented before the 3rd respondent on 1.6.2015, but the 3rd respondent kept the document pending without registering it or refusing to register it. With the aforesaid grievance, this writ petition is filed.

Learned Government Pleader for Revenue, on instructions from 3rd respondent, submits that names of property are not matching with the web land and hence the petitioner was requested to file an affidavit about the declaration of the property and if such an affidavit is produced, the 3rd respondent has no objection to register and release the document.

The learned counsel for the petitioner states that after notice was issued by this Court in the present writ

petition, the 3rd respondent called the petitioner and required him to file an affidavit which was accordingly complied with.

In view of that, therefore, the 3rd respondent shall take all necessary steps, process and register the development agreement-cum-Power of Attorney presented by the petitioner and if for any reason the 3rd respondent is not satisfied for registration of the document, he shall pass a reasoned order under Section 71 of the Registration Act, but shall not keep the document pending without passing any order. The 3rd respondent shall take appropriate action in accordance with law immediately after receipt of a copy of this order. The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs.
