THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.13116 OF 2007 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India, seeking to declare the action of the respondents in not releasing the balance payment to a tune of Rs.80,29,726/ - to the petitioner as per the letter of award of the 2nd respondent, dated 11.10.2003, as arbitrary and illegal.
When the matter is taken up for hearing, learned counsel for the 1st respondent submitted that they have not received any representation from the petitioner, and in fact, the representation was made only to the 2nd respondent and that if any representation is made by the petitioner, along with all material for consideration of the payment of the said amount, the same will be considered and appropriate orders will be passed.
In view of the submissions made by the learned counsel for the 1st petitioner, this writ petition is disposed of with the following directions:
The petitioner is directed to make a representation to the 1st respondent on or before 20.09.2017 before the authorities concerned along with relevant material, and on receipt of such representation, the authorities concerned are directed to consider the same and pass appropriate orders within a period of four (4) weeks from thereafter. No order as to costs. Miscellaneous petitions, pending if any, shall stand closed.
