THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.28694 of 2015 ORDER:

The grievance of the petitioner was with regard to the alleged inaction on the part of the police authorities in registering a crime based on his complaint dated 12.03.2015.

The Sub-Inspector of Police, Tadikelapudu Police Station, West Godavari District, filed a counter-affidavit furnishing the details of the crimes which were registered on the basis of the earlier complaints made by the petitioner and his rival party. The complaints so registered led to the filing of charge sheets by the police authorities and these cross cases are pending trial before the competent criminal court.

Though it is stated by Sri Y. Hema Chander, learned counsel for the petitioner, that civil litigation has also been initiated and an injunction order has been granted therein, it appears that the petitioner is not taking suitable remedial measures in the context thereof.

Insofar as the petitioner's complaint dated 12.03.2015 is concerned, the learned Assistant Government Pleader for Home placed before this Court the General Diary and also the register maintained in relation to non-cognizable cases wherein the police authorities concerned made entries vis-à-vis the said complaint. The registers also reflect that the police authorities concluded that the case was essentially a civil dispute and did not warrant criminal action. In the light of the afore-stated facts and as the police authorities have not been inactive in the matter and cross cases were registered basing on the complaints made by the petitioner and his rivals, this Court does not find any ground to interfere or infer that the police authorities have been inactive. The writ petition is devoid of merit and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
