HON'BLE SRI JUSTICE CHALLA KODANDA RAM CIVIL REVISION PETITION No.2348 OF 2015 ORDER:

This Civil Revision Petition is filed questioning the order dated 02.06.2015 passed by the learned Principal District Judge at Nalgonda, in I.A.No.397 of 2015 in O.P.No.280 of 2015. The Transfer O.P. No.280 of 2015 itself has been filed seeking transfer of O.P.No.66 of 2013 on the file of Senior Civil Judge Court, Miryalaguda. Whether the transfer petition is to be allowed or not is required to be gone into. Pending disposal of the transfer O.P., if the main O.P.No.66 of 2013 is allowed to be proceeded, the transfer O.P. itself would become infructuous. In that view of the matter, I do not find any infirmity with the order in I.A.No.397 of 2015 in Transfer O.P.No.280 of 2015 in granting stay. However, before granting such stay, petitioner ought to have been issued a notice. However, order in I.A.No.397 of 2015 in Transfer O.P.No.

280 of 2015 reads as if the stay order is passed till disposal of the transfer petition. Considering the submission of the learned counsel for the petitioner that the O.P.No.66 of 2013 is at the stage of arguments, I deem it appropriate to direct the learned Principal District Judge, Nalgonda, to dispose of the main O.P.No.66 of 2013 and pass final orders within a period of three months from the date of this Order.

With the above direction, the Civil Revision Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall also stand closed. ____________________________ CHALLA KODANDA RAM, J Dated:26.06.2015.
