HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.7213 OF 2011 ORDER:

In this petition filed under Section 482 Cr.P.C., the petitioners/A3 and A5 seek to quash the proceedings against them in C.C.No.256 of 2009 on the file of Judicial Magistrate of First Class, Nandyal, Kurnool District, registered for the offences under Sections 143, 188, 341 r/w 149 IPC.

When the matter came up for hearing, producing a copy of the order dated 08.11.2012 in Crl.P.No.2819 of 2010 of this Court, learned counsel for petitioners would submit that through the said order, this Court quashed the proceedings against A2 on the ground that the complaint was lodged in violation of Section 195(i)(a) Cr.P.C. and the petitioners/A3 and A5 also stand on the same footing and therefore, the proceedings against them may also be quashed. 3.

A perusal of the order in Crl.P.No.2819 of 2010 would support the submission of the counsel for petitioners. In view of the covered judgment passed in respect of petitioner/A2 in the very same case and as the petitioners/A3 and A5 stand on the same footing, this criminal petition is allowed and proceedings against petitioners/A3 and A5 in C.C.No.256 of 2009 on the file of Judicial Magistrate of First Class, Nandyal, Kurnool District, are hereby quashed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
