THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.27182 OF 2015 ORDER:

The petitioners were appointed as Special Officers on contract basis in Kasthuribhai Gandhi Balika Vidyalaya pursuant to the notification, dated 11-09-2013 after undergoing selection process. The 1st petitioner was posted to Chodavaram, 2nd petitioner was posted to Anandapuram and 3rd petitioner was posted to Golugonda. They took charge on 23-07-2013 and on 22-07-2013 respectively. It appears that the respondents 5 to 7 were kept under suspension along with two others and the 1st respondent issued a memo on 05-08-2015 granting permission to the 2nd respondent to direct the 3rd respondent to revoke the suspension order and continue the respondents 5 to 7 and two others as Special Officers in their respective places subject to the outcome of W.P.No.14287 of 2014.

The respondents 5 to 7 were appointed as School Assistants and they were deputed by the 2nd respondent on temporary basis to work as Special Officers as regular Special Officers were not appointed. When the official respondents did not repatriate respondents 5 to 7 and continuing them to work as Special Officers in Kasthuribhai Gandhi Balika Vidyalaya, the petitioners filed the writ petition to continue them in Chodavaram, Anandapuram and Golugonda respectively.

When the writ petition is taken up for consideration, it is submitted by the learned counsel for the petitioners that the 1st petitioner left the post and she is not interested in any manner in the present writ petition. Insofar as the petitioners 2 and 3 are concerned, they are supposed to work wherever they are posted and their services are being continued as on today. In the circumstances, it cannot be held that they are entitled to continue in the same place where they were initially posted. Therefore, respondents 2 to 4 are directed to issue appropriate orders with regard to posting of the petitioners. However, it is open to the

petitioners to submit a representation seeking transfer to the said place, if there are vacancies and the respondents 2 to 4 shall consider the same sympathetically.

Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
