Kumbha Venkateswarlu v. The State Of Andhra Pradesh, Rep.By Its Principal Secretary
THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.38644 of 2015 27.11.2015 Between:
Kumbha Venkateswarlu and others .. Petitioners and The State of Andhra Pradesh, represented by its Principal Secretary, Endowments Department, Hyderabad and others .. Respondents Counsel for the petitioners: Mr.T.Singaiah Goud for Mr.G.Venkateswarlu Counsel for respondent Nos.1 and 3: Government Pleader for Endowments (AP) Counsel for respondent Nos.2, 4 and 5: Assistant Government Pleader for Revenue (AP) Counsel for respondent No.6: Assistant Government Pleader for Home (AP) Counsel for respondent Nos.7 and 8: -- The Court made the following:
ORDER:
The petitioners, who claimed to be in possession of the houses allegedly allotted by respondent No.7, filed this writ petition with the grievance that respondent No.3 has been interfering with their possession and trying to dispossess them from the houses in their occupation.
A perusal of the record shows that the petitioners have earlier filed W.P.No.37834 of 2015 alleging that respondent No.8 society was threatening to dispossess them from their respective houses. During the hearing of the said writ petition, the learned counsel for the petitioners submitted that the prayer was not properly sought for in that writ petition, that respondent No.3 was the one who was actually interfering with the possession of his clients of their properties, and that therefore, they may be permitted to withdraw the said writ petition with liberty to file a fresh writ petition. Accordingly, the said writ petition was dismissed as withdrawn on 20.11.2015. As noted above, in this writ petition, the petitioners have alleged that respondent No.3 has been interfering with their possession.
The learned Government Pleader for Endowments (AP) appearing for respondent Nos.1 and 3, on instructions, submitted that though there is a dispute pending
between the Endowments Department and respondent No.8 society with respect to the management and administration of the society, respondent No.3, in no manner, is interfering with the petitioners' possession of the houses allegedly in their occupation.
In the light of the above submission of the learned Government Pleader for Endowments (AP), which is placed on record, the Writ Petition is disposed of. As a sequel to disposal of the Writ Petition, W.P.M.P.No.49741 of 2015 filed by the petitioners for interim relief shall stand disposed of as infructuous. _________________________ C.V.NAGARJUNA REDDY, J 27th November, 2015 GHN
