HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.11600 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Andhra Pradesh.

2. This writ petition is filed seeking writ of Mandamus declaring the action of the respondents in trying to remove the petitioner's dealership influenced by the local political leaders without issuing any notice, not following the procedure, as illegal and arbitrary and for a consequential direction to the respondents to allow the petitioner to continue as fair price shop dealer.

3 . It is submitted by the learned counsel appearing for the petitioner that though the officials of the 3rd respondent received demand drafts from the petitioner for the month of March, 2015 for release of the essential commodities, they have not released the essential commodities to the fair price shop of the petitioner. Admittedly, the authorisation of the petitioner is subsisting. During the subsistence of the authorisation, the respondents are under the duty to supply the essential commodities to the fair price shop of the petitioner.

4. In the circumstances, the writ petition is disposed of directing the respondents to issue essential commodities to the fair price shop of the petitioner during the subsistence of the authorisation.

Miscellaneous applications, if any, shall stand closed. No order as to costs.
