THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.24977 OF 2016 O R D E R :

Learned Standing Counsel appearing for the respondent Bank states that earlier the petitioner filed WP.No.34560 of 2015 and the same was dismissed. The said aspect is not disputed by the learned counsel for the petitioner and also not disclosed in the writ affidavit. Therefore, the writ petition is liable to be dismissed on the sole ground of suppression of said fact. A perusal of the order dated 28.06.2016 passed in WP.No.34560/2015 goes to show that the petitioner filed the said writ petition against auctioning of his property and the same was dismissed by the Division Bench of this Court for non-prosecution. But, the said fact was not mentioned in the writ petition. In view of the above, I do not see any reason to entertain the writ petition and the writ petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
