HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.17056 of 2018 ORDER: (Oral) (Per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioner has challenged the order dated 12th March 2018, passed by the Central Administrative Tribunal, Hyderabad Bench in O.A.No.189 of 2018.

By the aforesaid order, the respondents were directed to consider the case of the petitioner for promotion to IAS, subject to his eligibility and seniority basing on the availability of vacancies for the years 2017 and 2018.

Learned counsel appearing on behalf of petitioner submits that the petitioner has filed the O.A. before the Tribunal seeking direction to the respondents to comply with the Proviso to Regulation 5(2)(iii) of I.A.S. (Appointment by Promotion) Regulations, 1955. However, the learned Tribunal failed to issue such directions to the respondents. 4.
Keeping in view the averments made in the present petition and the submission of learned counsel for petitioner, we hereby dispose of the present writ petition directing the respondents to consider the case of the petitioner for promotion to IAS under Proviso to Regulation 5(2)(iii) of I.A.S. (Appointment by Promotion) Regulations, 1955, subject to his eligibility and seniority, basing on the availability of vacancies for the years 2017 and 2018 and pass appropriate orders.

The writ petition is accordingly disposed of. No order as to costs. 6.
