THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43360 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking a direction to the 3rd respondent to receive the complaint lodged by the petitioner dated 1.12.2015 and register a crime against the accused therein.
The main grievance of the petitioner is that the Station House Officer, Chilakaluripeta Town Police Station, Chilakaluripeta, Guntur District-3rd respondent herein is not registering a crime though the petitioner lodged a complaint on 01.12.2015.
Considering the grievance of the petitioner, the 3rd respondent is directed to receive the complaint made by the petitioner dated 01.12.2015 and register a case against the culprits alleged in the complaint if the said complaint discloses any cognizable offence and investigate into the same and file a final report either way in accordance with law. If the petitioner is aggrieved by the action of the 3rd respondent, he is at liberty to approach the superior officer of 3rd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.
Accordingly, the writ petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 14.12.2016.
