HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.2971 of 2018 ORDER:

The only prayer with which the petitioner has come up with the above revision is to direct the First Appellate Court to dispose of his application for stay filed under Order XLI Rule 5 of the Code of Civil Procedure, 1908.

2. Heard Mr. Y. Ramathirtha, learned counsel for the revision petitioner.

3. It appears that along with the appeal, the petitioner filed an application for stay. On 28-02-2018, the Court ordered notice to the caveator. The caveator seems to be taking time for filing counter. But in the meantime, they have also filed Execution Petition. Hence, the above Civil Revision Petition.

4. Considering the facts and circumstances, the Civil Revision Petition is disposed of directing the XI Additional District Judge, Krishna at Gudivada to dispose of I.A.No.382 of 2018 in A.S.No.11 of 2018, within a period of four (4) weeks from the date of receipt of a copy of the order.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
