THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19415 of 2019 O R D E R :

This writ petition is filed challenging the action of the 4th respondent in illegally arresting and detaining the petitioner at the office of the 3rd respondent without there being any sort of complaint or case registered by 6th respondent against the petitioner.

Learned Assistant Government Pleader for Home produced written instructions dt.05.09.2019, submitted by the Sub-Inspector of Police, Panjagutta P.S., Hyderabad.

To the extent of their relevance to the present writ petition, the said instructions read as under.

"It is submitted that the allegations made by the petitioner that 4th respondent illegally arresting and detaining him on 15.05.2019 from 18.30 to 23.00 Hrs for 41⁄2 hours at office is false and denied herewith, as the respondent No.4 never arrested or illegally detained the petitioner on 15.05.2019.

It is submitted that in fact basing on the complaint of one B.Satyanarayana, a case is registered against the petitioner Carnel Vimal Rajan in Crime No.268/2019, U/s.406, 420 IPC of Panjagutta Police Station on 03.06.2019. Wherein the said B.Satyanarayana alleged that the accused Carnel Vilaml Rajan is working as associate director Spa and on 27.04.2019 he went on sick leave and on the same date they came to know that he collected membership fees from various guest by cash with out issuing any receipt to the guest which amount Rs.4.27 lakhs. When they asked about him about cash he said that he will return the money after coming from leave after there is no response from him, then they issued show cause notice which was received by him at

his resident but even there, there is no proper response through phone calls/Mails.

It is submitted that the above case is under investigation for collection of evidence."

In view of the aforesaid written instructions, recording the same, the writ petition is disposed of granting liberty to the petitioner to avail alternate remedy against registration of crime and also for grant of bail. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
